If a last Will has been drafted, the probate process includes admitting the Will and distributing assets according to the Will. If the deceased dies intestate (with no Will), the decedent’s heirs inherit the decedent’s property according to Texas intestacy laws.
An executor or administrator is appointed, either according to the Will or Texas law, if no Will exists. The executor or administrator must carry out the probate process to help ensure the estate is distributed appropriately.
